Nicole Richie Restraining Order Made Permanent

http://www.radaronline.com/sites/radaronline.com/files/imagecache/350width/wenn2899546.jpgOn Wednesday, the hearing regarding the restraining order against Fabricio Luis Mariotto- the photographer Nicole Richie felt got too close to her daughter- has been continued until December 23, Radar Online has learned.

"The restraining order hearing has been continued until December 23. All orders remain in effect,” Richie’s lawyer Mark Geragos told Radar Online.

Nicole Richie was at the courthouse this morning for the hearing, but was kept away from the media in a secluded room. Richie believes Mariotto was lurking around her daughter Harlow's preschool and is seeking to have a temporary restraining order made permanent.

A source close to the situation added that "both parties are trying to reach an amicable settlement."

Mariotto told Radar Online: "I don't want a restraining order. Nobody waits on her, its not like she is Angelina [Jolie]."

He added that he didn’t realize he was photographing Nicole’s daughter at her school and had simply followed Nicole without realizing she had gone to a preschool.

“I’m not a bad guy, I was driving erratically,” he said.

Nicole Richie Will Appear In Court Against Photog

http://www.radaronline.com/sites/radaronline.com/files/imagecache/350width/GYI0062629577.JPGNicole Richie may take the stand Wednesday during a hearing in which she hopes a judge will slap a permanent restraining order against a photographer whom she feels is getting too close to her young daughter, Radar Online has exclusively learmned.

Nicole is seeking to extend a temporary restraining order -- or TRO -- against the photographer whom she claims is lurking around her daughter Harlow's nursery school. Richie will be in court with her powerhouse attorneys Tamar Arminak and Mark Geragos.

A source close to the situation tells us: "Nicole's attorneys will put on the stand several preschool teachers from Harlow's school that have witnessed this photographer crossing the line trying to get pictures. Nicole is fiercly protective of her children, and won't tolerate this. Nicole could testify also."

Nicole "is very busy planning her wedding to Joel, but she will drop everything to protect their children," the source said.

Under California law, a temporary restraining order lasts for three weeks, but if the TRO is made permanent, it will extend the order to up to three years.

The hearing will take place Wednesday morning at the civil court in downtown Los Angeles.
