New Witness Comes Forward For Lindsay Lohan

http://www.radaronline.com/sites/radaronline.com/files/imagecache/350width/wenn3155750.jpgIn a new development in her felony theft case, Lindsay Lohan has an ace up her designer sleeve -- a witness who has come forward that will blow the prosecution's claims out of the water, her father Michael Lohan told Radar Online in an exclusive new interview.

Accused of stealing a necklace the store claims is valued at $2,500, Lindsay is facing felony charges, but a new witness will offer solid evidence that may keep the 24-year-old Mean Girls star out of jail.

"A man contacted Lindsay's camp and told them he went into the jewelry store way before Lindsay did and was interested in buying the necklace," Michael revealed to Radar Online. And, the bombshell?

"They told him it was $800."

According to Michael, the man heard about Lindsay's predicament and came forward to tell his side of the story about the necklace, and he has volunteered to testify for Lindsay if there is a trial.

Elated at the news of the new witness and confident that this will be a blow to the prosecution of his daughter, Michael explained to Radar Online the effect he expects the man's testimony to have on the case.

"This witness will completely exonerate Lindsay and prove that the necklace isn't worth $2,500, and prove that she shouldn't have been charged with a felony."

Lindsay Could Escape Jail – Even If Convicted

http://img2.timeinc.net/people/i/2011/news/110221/lindsay-lohan-240.jpgLindsay Lohan has a reasonable chance of avoiding jail and even a conviction in her felony grand theft case, even though she's been accused of stealing several times in the past, legal experts tell PEOPLE.

"This is far from a slam-dunk case," says L.A. criminal defense attorney Steve Sitkoff of the allegation that the actress, 24, stole a $2,500 necklace.

"All her attorney has to do is convince one juror it was an innocent misunderstanding and she could walk, unless they decide to retry her again."

Adds L.A. criminal defense attorney Harland Braun: "Even if she's convicted, I doubt she'll get state prison time because she's not a physical threat to the public. Prison is generally regarded as a place for hardened criminals, not someone who clearly has mental issues. She has a defensible case."

Experts also agree that her past theft allegations could be used against her in court depending on whether the judge finds the accusations relevant.

Here are among the possible resolutions to the actress's case:

• Lohan could reach a plea deal without going to trial, and be sentenced to anywhere from six months to a year in county jail for the alleged theft as well as for violating her probation. "In this case, the court could figure out a way to make sure she does substantial time and forbid her from early release due to overcrowding," Sitkoff says.

• She could also strike a deal in which she only gets felony probation with no jail time and if she stays out of trouble for three years, the judge could reduce the charge to a misdemeanor. Lohan's attorney Shawn Chapman Holley stated on Thursday she was seeking this as a possible outcome.

• The actress wins at trial by convincing jurors she didn't intend to steal. However, Lohan could still face a probation violation and return to jail without a conviction in the theft case.

• Lohan could go to trial and lose, and could be subject to harsher punishment if the judge decides she was being deceitful to the court. "But if she loses at trial, I can't see her getting more than eight months in state prison," Braun says.

Lindsay Considering Jail-Free Plea Bargain

She entered a "not guilty" plea in Los Angeles Superior Court on Wednesday, but Lindsay Lohan would consider taking a deal if no prison time were involved in the bargain, according to her attorney.

"Ms. Lohan maintains her innocence, and now that I've seen the police reports, I believe the case is entirely defensible," Shawn Chapman Holley told CNN. "Having said that, we will entertain a discussion concerning a plea if it means no jail so that she can move forward with her recovery and her career."

The Mean Girls star, 24 stands accused of stealing a $2,500 necklace from a Venice, Calif. jewelry store on January 22. If convicted she faces up to three years in prison.

Lohan, whose probation for a 2007 DUI conviction was revoked, was released yesterday after posting 10 percent of the $40,000 bail ordered by Judge Keith Schwartz. The next hearing on the matter is February 23.

Jeweler's Inconsistency Will Help Lindsay Lohan

The police report detailing how Lindsay Lohan allegedly stole a $2,500 necklace from an L.A. jewelry store shows two puzzling inconsistencies in the jeweler's story -- inconsistencies that could help Lindsay beat the rap.

According to the report, obtained by TMZ, the jeweler first told cops Lindsay had been in the store three times before the alleged theft -- looking at the necklace in question. The next day, the jeweler changed her story and said it was actually a ring Lindsay had been eyeing on previous visits and never looked at the necklace.

And there's another inconsistency. According to the report, on January 23, the owner told cops, "The surveillance video revealed that as Kaman [owner] was talking to Lindsay's male friend, Lohan reached up to her neck area with both hands, removed the store necklace, and placed it inside her black Chanel bag."

But the next day, the owner changed her story, saying Lindsay walked out of her store with the necklace around her neck. The reason for the inconsistency -- the owner claims she reviewed the video on a different monitor the second time and saw it differently.

The jewelry store owner's credibility is crucial because Lindsay claims the owner loaned the necklace to her.

Lindsay Lohan Enters 'Not Guilty' Plea

Having been formally charged with grand theft, Lindsay Lohan made her way to court for an initial appearance on Wednesday afternoon (February 9).

The “Mean Girls” actress was arraigned at Airport Courthouse in Los Angeles, as she was clad in a white dress while joined by legal staffers and security personnel while readying to face the judge.


As was expected, Lohan entered a 'not guilty' plea with a bond being set at $20,000 with the order that she be remanded to sheriff's custody.

Continuing to lecture Lindsay about staying out of trouble and the heftiness of a felony charge, the actress' lawyer tried to have bond paid immediately - but she was denied that option while being told that procedure must be the same in this case as for everyone else.

Lindsay To Be Charged with Felony Grand Theft

http://img2.timeinc.net/people/i/2011/news/110103/lindsay-lohan-240.jpgLindsay Lohan will be charged today with one felony count of grand theft for allegedly stealing a $2,500 necklace from a Venice, Calif., jewelry store on Jan. 22, the Los Angeles District Attorney has announced.

She is required to show up in person for an arraignment at an L.A. courthouse Wednesday afternoon. If convicted, Lohan, 24, potentially faces several years in state prison.

The actress's attorney Shawn Chapman Holley has denied Lohan committed any crime and plans to defend her in court.

A source close to the actress insisted the necklace was borrowed, not stolen. The source recently told PEOPLE, "Lindsay's used to getting gifted items that are worth way more than that. And why would she steal a necklace? She has tons of jewelry and doesn't need any more."

"The prosecutors have an uphill battle ahead because they must prove criminal intent, that Lindsay knew she wasn't authorized to remove the necklace from the store," says L.A. criminal defense attorney Stanley L. Friedman, who's not involved with the case. "Her attorney will almost certainly argue this was all just a misunderstanding."

"If she's convicted, the fact that Lindsay's on probation makes it more likely that she's headed for state prison versus jail," Friedman adds. "And in prison, they never release inmates early for overcrowding, only for good behavior."

LAPD detectives obtained a search warrant last week to search Lohan's Venice home, but before they descended on the actress, the necklace was returned to the police station, according to an LAPD statement.

Lohan is also currently under investigation by Riverside County prosecutors for allegedly battering a Betty Ford employee.

In her DUI case alone, L.A. Superior Court Judge Elden Fox previously warned Lohan on Oct. 22 that any more slip-ups would be met with six months in jail.

Lindsay Lohan: Up for a Role in New 'Superman'

Look! Up in the sky! It's a bird, it's a plane, it's ... Lindsay Lohan?

Sources close to LiLo tell TMZ ... Lindsay's people have had multiple phone conversations within the last few weeks with the people behind the new "Superman" reboot. We're told Lindsay is up for a role in the flick -- and while it isn't Lois Lane, we hear it would be a "major character."

We're told Lindsay is supposed to meet personally with the "Superman" people soon -- but she might be a little busy with that felony grand theft charge thing.

According to our sources, Lindsay is "dying to show people again how talented she is" and is worried this latest run-in with the law (for which she maintains she's innocent) could ruin her shot at the movie.

Apparently that necklace she's accused of stealing is made out of kryptonite.

Reps for Warner Bros had no comment.

Lindsay Slams 'Glee' -- Leave My Mother Alone!

Lindsay Lohan and "Glee" kissed and made up after the cast apologized for the LiLo joke they made last year -- but after the show badmouthed her mother last night, they're back to being enemies.

In the big Super Bowl episode last night, Dina Lohan was included on a fictional list of "losers of the year" -- this after the show called Lindsay "crazy" in an episode last November.

Sources close to Lindsay tell TMZ she feels the show should "mind its own business" and "stop picking on their family."

E*TRADE Baby Can't Say 'Lindsay' Or 'Milkaholic'

Here's the catch: there are two words that are not permitted to come out of the football helmet-wearing baby's mouth: "Lindsay" and "Milkaholic," Radar Online reports.

The ban is a result of the settlement last year between Lindsay Lohan and the investment giant. It sprung out of a spot that had one of the talking babies refer to his girlfriend Lindsay as a "milkaholic."

Lohan sued the investment giant, alleging it defamed her. It was resolved out-of-court last September, with her attorney Stephanie Ovadia telling Radar Online exclusively, "We've settled with E*TRADE."

Lohan supporters consider the E*TRADE "Lindsay" ban a victory; that even with felony theft charges looming over her, sometimes even small victories matter.

Radar Online reached out to Ovadia for comment, but the lawyer declined.

Lindsay Faces Felony Charges For Jewelry Theft

TMZ.com reports the troubled actress, 24, will be charged with felony grand theft after allegedly swiping a $2,500 necklace from a Venice, Calif. jewelry store.

If convicted, Lohan faces up to three years in prison, the site reports.

For her part, Lohan claims that her stylist failed to return the "one-of-a-kind" bauble on time to Kamofie & Company, the store that lent it out to her January 22.

Though the piece has since been returned, Lohan was captured on the store's security camera wearing the necklace and is said to have been photographed with the accessory one week later.

The Los Angeles County District Attorney's office is expected to file charges as early as Monday.

The Mean Girls actress remains on probation stemming from a 2007 DUI arrest and is due in court for a progress hearing February 25. She completed a 90-day rehab stint at L.A.'s Betty Ford Center on January 3.

Lindsay's Friend Gives Stolen Necklace To Cops

Well this doesn't look good for Lindsay, a friend of hers has just turned in a piece of stolen jewelry to police in LA, Radar Online has learned.

Radar Online broke the world exclusive story yesterday that police requested a search warrant after seeing both a photograph as well as a video of Lindsay wearing the one-of-a-kind necklace worth $2,500 which someone had stolen from a store in - you guessed it - Venice Beach.

Police tell Radar Online the necklace is now being kept is a safe to use as evidence. It will ultimately be up to the D.A.'s office whether to pursue any charges in the case.

The search warrant was never put into action because the necklace was returned.

UPDATE:  Lindsay Lohan is claiming that this all is a misunderstanding. She says that she just borrowed the necklace and then returned it to her stylist who was late getting back to the jeweler.

Lindsay Lohan Suspect In Jewelry Theft

Radar Online also learned investigators told the court they have video of the 24-year-old Hollywood actress wearing the missing item!

"Lindsay is being accused of stealing high end jewelry, including a necklace,” a law enforcement source with knowledge of the situation told Radar Online.

“A search warrant was requested Tuesday at the Airport Court to search Lindsay's house for the item of jewelry in question.

“Lindsay has been photographed and there is video of her wearing the jewelry she is accused of stealing.”

If the jewelry is valued at $5,000 or more, the Mean Girls starlet, who is relishing her freedom after jail and rehab, could be charged with a felony.

It's unclear if the judge signed off on the search warrant.

Lindsay Lohan and Samantha Ronson hit up a strange party last week -- where the theme seemed to be bleeding from the eyes and weird 3D type glasses.

The horror-themed party went down last Thursday, a birthday gathering for a mutual friend. A spy at the party tells TMZ LiLo and Sam only stayed about an hour ... and neither of them drank.

As for those crazy glasses ... we're told the user is supposed to wear them with their eyes closed ... and lights placed inside the frame FLASH along with the beat of the music to create a "tripped out effect."

It's good to see the only way Lindsay is tripping ... is through technology.

Lindsay Lohan: Tom Hardy Is Just a Friend

For anyone who believes rumors that she's dating actor Tom Hardy, Lindsay Lohan wants to set them straight.

"Tom Hardy is just a friend of mine ... The tabloids are wrong," she Tweeted Monday.

The actress, 24, left rehab earlier this month when rumors of her supposed romancing of Hardy began to spread. The British actor was recently cast as the villain, Bane, in the next Batman movie, The Dark Knight Rises.

Stop us if you heard this one before -- Lindsay Lohan is telling her friends she is never clubbing again. As in forever. Forever ever. For reals. Stop laughing.

Sources close to LiLo tell TMZ she is "completely over the club scene" -- no more "I'll just have water, thanks" -- and realizes that cutting it out completely is the best chance for her to avoid temptation and remain sober.

We're also told the no clubbing pledge extends to her friends as well -- as in she's going to stop hanging out with the people that only used her to party.

Which pretty much only leaves her trainer and the pizza delivery guy.
